2008 IMPULSE - MEMBERSHIP AGREEMENT

THIS MEMBERSHIP AGREEMENT (the “Agreement”) is made between Impulse Youth Arts Organization, (“IMPULSE Drum & Bugle Corps”), and.....

_______________________________________________ (“I”). In consideration of the opportunity to become a performing member of IMPULSE, I acknowledge and agree that:

1. REHEARSAL CONFLICTS

School events constitute valid reasons to miss rehearsals, but I must clear all absences with caption heads, and notify members in my section. I understand that I am required to attend all IMPULSE

activities after June 15, 2008 .

2. OUTSTANDING FINANCIAL OBLIGATIONS

I have no outstanding financial obligations with any other drum and bugle corps, and I agree that any and

all financial obligations to IMPULSE must be paid in full before I may participate in the winter or summer programs of any other organization.

3. Fees and Financial Obligations

I promise to pay the 2008 tuition per the Fee Schedule sheet provided:

$75 Registration Fee

$20 monthly winter season fee from date of joining through July.

$1,850 Summer Tour

(We recommend each member raise minimum $150 per month to offset your personal costs)

Other mandatory Fundraising is detailed on the Fee Schedule Sheet.

4. WITHDRAWING OR QUITTING IMPULSE

To withdraw from IMPULSE, I must request and complete a Performer Withdrawal Form and present it

to an authorized representative of IMPULSE. The form is not considered accepted unless signed by the

authorized representative. Refunds are clearly outlined in the Fee Schedule Sheet. Whether a refund results, depends on the payments made. Failure to attend rehearsal or merely giving notice to an instructor or member will not be regarded as notice of withdrawal, and fee charges will accrue until the Performer Withdrawal Form is accepted.

5. IMPULSE PROPERTY

I am financially responsible for the repair or the replacement of my uniform and instrument resulting from

my careless or negligent use of these and any other IMPULSE property while in my trust.

6. DRUGS AND ALCOHOL

Drugs and alcohol, including tobacco, are not permitted at IMPULSE rehearsals, camps, functions, and

tours. I agree to fully abide by this policy or forfeit my membership.

7. PROFESSIONAL AND APPROPRIATE BEHAVIOR (aka: Rules of Conduct)

a. Use of profane, racial, sexist or otherwise offensive language or behavior directed towards another person or group of people (another drum corps, drum line etc.) at any time while an active membership with IMPULSE. Doing so will be dealt with immediately and may result in the immediate dismissal of the member from the organization.
b. Fighting is prohibited. Any physical altercation which occurs will be dealt with immediately and may result in the immediate dismissal of the member from the organization.
c. Any unlawful behavior "will" result in immediate dismissal of the member from the organization.
d. The member at all functions shall maintain a disciplined demeanor. (see item a)

e. INTERNET USAGE: Any member shall not do any of item a. while using the internet. Any posts made in public or private forums on the internet that put any unti of the IYAO in a negative light or complains about happenings while a member of IMPULSE will result in the immediate dismissal of the member from the organization.

8. MARCH 1st RELEASE CLAUSE
(no corps hopping) If I participate in IMPULSE in 2008 and decide on or after March 1, 2008 to march in another drum and bugle corps, I must get IMPULSE Executive Director's written permission to join the other corps in the 2008 season. Permission may or may not be granted and is the sole discretion of the Executive Director.

9. COMPLETION AND RETURN OF FORMS
I will sign and return all membership forms.

10. VIDEO AND/OR AUDIO RECORDINGS
I hereby grant IMPULSE the perpetual, fully-paid, exclusive and worldwide right to make video and/or audio recordings (“Recordings”) of my performances or rehearsals with IMPULSE (“Performances”) and to use my name, voice, likeness, image and biographical information in connection with the production and commercial exploitation of such Recordings, and to permitted assignees grant others the right to make and commercially exploit such Recordings. I acknowledge and agree that the rights granted hereunder shall include the perpetual, fully-paid, worldwide right to edit, televise, broadcast, record, publish, copy, use, license, print, sell, distribute or otherwise exploit the Recordings in any manner and in medium, format, form or forum, whether now known or hereafter devised, without any further compensation.

11. COPYRIGHT OF RECORDINGS
I understand and agree that the copyright to the Recordings shall be solely owned by IMPULSE. To the extent applicable, this agreement shall be considered a “Work-for-Hire” agreement as to the Performances. I grant IMPULSE all right, title and interest in and to the Performances, and all results, product and proceeds thereof, with no reservation of any rights. I relinquish any claim of ownership or rights in and to my Performances, including but not limited to all “moral rights.” To the extent necessary to fully transfer all of these rights to IMPULSE, alternatively, I hereby assign IMPULSE all right, title and interest in and to the Performances, and to the extent that such assignment is not effective, I grant IMPULSE a fully paid-up, perpetual, world-wide exclusive license to use and exploit my Performance in any manner and in any medium, format, form or forum, whether now known or hereafter devised, without any further compensation.

12. ASSIGNING OF RIGHTS
The rights granted herein in Section 9 and 10 are freely and fully assignable by IMPULSE to any other entity or organization, including but not limited to Drum Corps International, Inc.

13. CAUSE FOR TERMINATION
I am aware that failure to meet any of the obligations or commitments described above, or in Impulse member handbook, constitutes good cause for expulsion from IMPULSE.

14. SIGNATURE

I have read and fully understand the contents of this Agreement and/or have had the contents fully explained to my satisfaction.
